Welcome to the terms of service for ModBot.

ID: 790967448111153153 The following terms and conditions apply to every user of the Discord Bot “ModBot” hosted by the Aternos GmbH (henceforth referred to as “ModBot” or “the bot”).

§1 - Availability of our services

  1. ModBot is usually available 24 hours per day, but interruptions of this availability might occur because of planned maintenance or unforeseen events. A faultless operation of the bot is technically impossible, and therefore we cannot accept the responsibility for errors of any kind.
  2. The availability of the bot depends on conditions and benefits beyond our influence, e.g. your internet connection or the availability of the Discord API. We are not responsible for disturbances caused by those conditions.

§2 - Using ModBot in your server

  1. When you add ModBot to your server, it will register its commands with sensible default permissions. You are responsible for ensuring that your permissions are set up correctly. We are not responsible for possible privilege escalations caused by incorrectly set up slash command permissions.
  2. We reserve the right to deny you access to our bot and to leave your server immediately without giving any reason. This applies in particular in case of violation of applicable law or our terms of service. In those cases, releasing any data is not possible.
  3. Additionally, we reserve the right to access your data at any time without notice and to modify or delete them.
  4. Other users might use the bot on your server. You are always responsible for servers created by your account and must ensure that other users only use the bot in accordance with these terms of service. All actions taken by other users on your servers are final and cannot be undone.

§3- Support

  1. If you have any questions about the bot, you can create an issue on our bug tracker or ask on our Discord. It might, however, take some time before you receive an answer to your question, and we do not guarantee an answer to support requests.
  2. We use third-party services such as Discord and GitHub to allow communication and interaction between users. We do not take responsibility for any support given by other users. All third-party services are subject to their own terms and conditions.

§4 - Abuse and limitations

  1. You agree to use the provided services only for their intended purpose and to comply with applicable law. The abuse of services is prohibited. Likewise, disproportionate use of the provided resources is to be avoided. We reserve the right to delete your user account and all associated data immediately.
  2. Any automated execution of commands is forbidden.
  3. Excessive use of our provided resources is prohibited.
  4. An infringement of these terms of service can result in deletion of your data.
  5. Serious misuses such as attacks against the infrastructure of our bot or third parties (e.g. the execution of DDOS attacks or malicious programs), fraud, or other criminally relevant activities can be reported to law enforcement.

§6 - Data

  1. We store your server data according to our privacy policy: https://aternos.gmbh/en/modbot/privacy
  2. Kicking ModBot from your server removes all data and settings stored for that server permanently.
  3. You can export your data using the command “/export”. This also allows you to import it -
    1. On another server using the bot
    2. On another instance of ModBot hosted by you or someone else
    3. In a different Discord bot that understands our data format

§7 - Final clauses

  1. We reserve the right to change the bot and our services, including these terms of service, at any time.
  2. If a provision of this agreement is or becomes legally invalid or if there is any gap that needs to be filled, the validity of the remainder of the agreement shall not be affected thereby. Invalid provisions shall be replaced by common consent with such provisions which come as close as possible to the intended result of the invalid provision.
  3. If you violate these terms and conditions, and we do not take action against you, we are still entitled to enforce our rights when you violate these terms of service.
